The notarial fee for an ordinary will is at most 50 złoty net, for a will with an ordinary bequest, an instruction or disinheritance 150 złoty net, and for a will with a specific bequest (zapis windykacyjny) 200 złoty net. VAT is added on top, along with a charge per started page for each wypis. A handwritten will costs nothing.
What the bill is made of
The amount you pay at the notary office is usually three items:
- the notarial fee for drawing up the deed, capped from above by regulation,
- VAT added to that fee,
- wypisy of the deed, charged per started page.
The regulation sets maximum rates. An office may go below them and sometimes does in simple matters, but it cannot demand more.
Why a will with a specific bequest costs more
An ordinary will appoints an heir to all or part of the estate. A specific bequest (zapis windykacyjny) goes further: it names a particular asset, a flat or a stake in a company, which passes to the named person directly when the succession opens, bypassing the division of the estate. That is a different construction and a higher fee rate.
If you want a particular person to receive a particular thing without later negotiations with the family, the difference in the fee is the cheapest part of that decision.
When a notarial will is worth its price
The notarial form is not compulsory. A handwritten will is valid, free, and you can write it tonight. A notary has the advantage wherever the risk of a dispute grows:
- when you appoint someone outside the statutory circle of heirs, for example a partner you are not married to,
- when you disinherit someone or formulate a specific bequest,
- when a family member may question your state of awareness,
- when the document needs a safe place of storage and an entry in the Notarial Register of Wills.
What the price of a will does not cover
Drawing up a will is one thing; the later succession proceedings are an entirely separate matter with separate costs. Confirmation of acquisition of the estate, division of the estate and any claim for a reserved share are settled at their own rates, regardless of what you paid for the deed itself.
